The timing of the so called move coincides- to the minute- with Baffert seeking an “ emergency” preliminary injunction seeking a Stay of his suspension on the grounds, among others, that he will be irreparably harmed by loss of business. Hmmmm!

Those races were not run on the Wilson chute. They started mid way on the clubhouse turn. And it was a dumb idea. The Wilson chute, as I understand it, is a straightaway that will join the main track coming out of the clubhouse turn- an area currently used for parking.

Bit- it is sort of laches! As a general rules the party asserting the doctrine of laches-here Churchill Downs- would have to claim it was prejudiced or changed its position by Baffert sitting on his rights. That is not the case here where CD has taken its position. I can’t speak for Kentucky courts specifically but most judges do not look fondly on a party seeking a TRO at the last minute when t

So Cal- he was a good Judge and former Corporation counsel of NYC. But he will not employ as an approach what you suggest for various reasons. First, this is a really high profile case that has the potential to land him- as it does many retired judges- a boat load of future mediation work. Second, and perhaps more importantly, there is likely to be an appeal- whether it is to District Judge Caro

This past Saturday night, in the last race at Delmar, Anna Fantastic went into the gate at 5-1. Anna Fantastic won. Anna Fantastic returned 9-5.mThere was no intermediate drop. 5-1 to 9-5 in one freaking flash - the last flash. I saw a blog on Monday stating that approximately $70k- more than 40% of the win pool- was bet in the last 90 seconds of betting. A sophisticated bettor might say that the

As much as as I hate what Baffert has done to the game, Judge Almon’s decision is absolutely correct as a matter of law.. The key is that Judge Almon found ( correctly in my view)NYRAs relationship with New York State is such that it’s actions are deemed state actions requiring due process, i.e. a hearing. Judge also recognized that money damages would be hard to calculate and coupled with a

Denver- I assume, given the passion of your post, you read the entire hearing transcript and reviewed every exhibit in evidence? Oh, you didn’t? As you stated, there is an administrative appeals process in NY that tell us all whether there was sufficient evidence and the suspension ( vote was 5-0) was appropriate. I have no dog in this show and know Linda trains for TGJB- let’s permit the leg

If the split sample confirms the results of the first, can you explain to the Board why, exactly, the charges will be dropped? Is there an exception in the regs that if the steroid enters the horses system through his behind ( assuming arguendo that was the sole source of entry) rather than his ankle it’s ok?

Like others on this string and the related postings on this board, I also have no idea whether Baffert was using and am not smart enough to climb inside his head regarding the risk reward. I do seek to challenge some of the assertions I have read here. First, when it is written that the drug in question “ does not move a horse up†I don’t know what that means. The fact that it is not EPO doe

There are advantages - and disadvantages- to both formats. Pick and pray requires the handicapper to figure out value( odds)in advance without a live tote board and is better at allowing a player to protect against someone far behind simply reaching for a bomb as a last minute desperation play.If you are going to play a bomb in the last race or two in a pick and pray, you have to figure out in ad

BlueChip- mug shots in federal cases are uncommon and difficult to obtain as a result of a 6th Circuit Court of Appeals Decision ( Cincinnati)several years ago which held them to be “ humiliating “ and serving no legitimate purpose ( in the context of a news organization seeking same). As for the “trial dateâ€- the Jets have more of a chance of winning the Super bowl than the Navarro and S

Thanks- The Saratoga streak went from 1973 ( the Alabama-Desert Vixen, Tom Root, Braulio Baeza) through 2019! Sad but we will all survive. As to your hypothetical, it is speculation as to how any bettor would or might hedge given the will pays. Stay safe, look forward to a new streak starting next year) and to those who observe ( actually to all) a Happy, Healthy , Prosperous and SAFE New Year.R

Wrongly -Before even reaching the legal obstacles to liability on the part of the ADW ( there are many) the bettor in your position must first claim to have suffered damage by the improper or incorrect posting of a will pay. Other than the understandable psychic damage you suffered, how have you been damaged? You ultimately were paid what you and other bettors should have been paid for your wa

The problem I see with respect to tracks suing is such suits would open them up to pre trial discovery regarding what they knew and what they did ( or did not do)with information in their possession. If I were representing a disgruntled owner suing Servis, Navarro etc. I would consider naming the tracks as defendants in any lawsuit.

After apologizing, he advised me 1.re the betting, there was no past posting, a fact that was already common knowledge and 2. he could not discuss matters under investigation and made clear horseplayers were not the only ones aware of the alleged drug use and
